1. Acceptance of Terms

By accessing or using MoldRiskIQ ("the Service," "the Platform," or "the Company"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. The Service is operated by MoldRiskIQ and is available to users within the United States for properties located in any U.S. state.

2. Description of Service

MoldRiskIQ provides algorithmic property moisture and mold risk assessments based on publicly available data, third-party data providers, climate models, terrain analysis, and construction intelligence. The Service generates risk scores, risk bands, and narrative reports for residential properties nationwide.

The Service is provided on an "as-is" and "as-available" basis. Risk assessments are algorithmic estimates and do not constitute professional home inspections, environmental testing, or clinical mold diagnoses.

3. No Professional Advice / Informational & Educational Use Only

All reports, analyses, scores, summaries, and outputs provided through this Platform (the "Services") are for informational and educational purposes only. They are designed to help users identify potential risk factors and make more informed decisions, but they are not a substitute for independent professional evaluation.

The Services do not constitute environmental, legal, engineering, construction, real estate, or medical advice, nor do they represent a formal mold inspection, environmental assessment, or certified property evaluation.

Users should obtain independent professional inspections and advice before making any decisions regarding a property. No output from this Service should be interpreted as a guarantee or assurance regarding the presence, absence, or severity of mold, moisture intrusion, or any other property condition.

4. User Accounts

To access certain features, you must create an account by providing your name and email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current information during registration.

5. Pricing and Payment

MoldRiskIQ offers the following products:

Risk Snapshot: Free — includes overall risk score, risk band, and summary analysis. Available nationwide.
Property Risk Report: $29 per property — a comprehensive 12-section analysis with PDF download capability. Available nationwide.
Full AI Report: $79 per property — includes disclosure analysis, water damage indicators, and adjusted risk scoring. Users upload their own seller's property disclosure and it is reviewed as part of the analysis.

Reports are priced per property. Each report purchase grants you unlimited access to that specific property's report. All payments are processed securely through Stripe.

6. No Refunds Policy

All sales are final. MoldRiskIQ does not offer refunds under any circumstances.

Because our reports are digital products that are generated and delivered instantly upon purchase, all payments are non-refundable. Once a report has been purchased, the algorithmic analysis is executed, data is retrieved from third-party providers, and the report is generated and made available to you immediately. This process cannot be reversed.

This no-refund policy applies to all report tiers, including the Property Risk Report ($29) and the Full AI Report ($79), as well as any tier purchased before the current pricing took effect. By completing a purchase, you acknowledge and agree that:

You understand the nature of the product you are purchasing before completing the transaction.
You have reviewed the product description, sample report sections, and tier comparison on our Pricing page.
You agree that no refund, credit, exchange, or chargeback will be issued for any reason, including but not limited to: dissatisfaction with report content, disagreement with the risk score, duplicate purchases, inability to use the report, or change of mind.
Consultation appointments (Pro tier) that are missed or not scheduled within 60 days of purchase are forfeited and non-refundable.

If you believe there is a technical error with your report (e.g., the wrong property was analyzed due to a system error), please contact us at support@moldriskiq.com within 48 hours of purchase. Technical errors are evaluated on a case-by-case basis at the sole discretion of MoldRiskIQ and do not guarantee a refund or credit.

7. User-Uploaded Documents

The Verified Property Analysis and Professional Assessment tiers require the user to supply their own seller's property disclosure, inspection report, or equivalent documentation ("User Documents") to enable disclosure-based analysis. Users may obtain their seller's disclosure by contacting the real estate agent or firm involved in their transaction.

User Representation & Warranty. By uploading any document to the Platform, you represent and warrant that:

Your upload is a willful submission and you have the legal right to share the document with the Company for analysis purposes.
You have lawfully obtained the document through legitimate means (e.g., as a party to the real estate transaction, through your agent, or through a public records request).
The document, to the best of your knowledge, is authentic and has not been materially altered.
Your use of the document and your sharing it with the Company does not violate any applicable law, regulation, or contractual obligation.

You assume all responsibility for the accuracy and legality of any documents you upload. The Company does not verify the provenance or authenticity of User Documents.

8. No Agency Relationship

The Company does not act as your real estate agent, broker, or representative in any capacity. No agency relationship, fiduciary duty, brokerage relationship, or representation is created between you and the Company as a result of your use of the Services.

By submitting documents and purchasing analysis, you are not entering into any agency relationship, contract, or engagement with MoldRiskIQ or its representatives. You waive all claims arising from the analysis of submitted documents.

9. Consultation Services

The Professional Assessment + Consultation tier ($529) is no longer offered for sale. Customers who purchased it before it was retired remain entitled to the 30-minute video consultation it included, scheduled through our online booking system and subject to availability.

Consultations must be scheduled within 60 days of purchase. Failure to schedule within this window results in forfeiture of the consultation — no refund, credit, or extension will be provided.
Consultations that are missed, canceled with less than 24 hours' notice, or where the client fails to appear ("no-show") are considered delivered and non-refundable.
Consultation content is informational and educational only. It does not constitute medical, legal, engineering, or environmental advice.
Consultations are not recorded by default. If you wish to record the session, you must obtain mutual consent.

10. Assumption of Risk

You acknowledge that:

Property condition data, including seller disclosures, may be incomplete, inaccurate, outdated, or subject to human error.
Mold risk cannot be definitively determined without physical inspection and environmental testing.
You assume all risk associated with relying on any information provided through the Services.
Reports generated from user-uploaded documents are limited to the information contained in those documents and may not reflect the complete condition of the property.

11. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless the Company, its owners, officers, employees, contractors, Agents, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising out of or related to:

Your use of the Services
Your reliance on any reports or analyses provided
The use of any documents you upload to the Platform
Any documents you upload to the Platform, including claims related to intellectual property, privacy, or unauthorized disclosure
Any decisions you make regarding a property
Any chargeback or payment dispute you initiate

This includes, without limitation, any claims related to property condition, environmental hazards (including mold), or undisclosed defects.

12. Limitation of Liability

To the maximum extent permitted by law, the Company and its Agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:

Property damage
Personal injury
Health-related claims
Financial losses arising from real estate transactions
Loss of profits, data, business opportunities, or goodwill

In all cases, the total liability of the Company shall not exceed the amount paid by you for the specific Service giving rise to the claim.

13. Intellectual Property

All content, algorithms, scoring models, report templates, branding, trade names, and copyrighted materials associated with MoldRiskIQ are the intellectual property of MoldRiskIQ. You may not reproduce, redistribute, reverse-engineer, or commercially exploit any part of the Service without written permission.

Reports purchased by you are licensed for your personal or professional use. You may share reports with clients, agents, or other parties involved in a real estate transaction involving the assessed property. You may not resell, republish, or commercially distribute reports.

14. Affiliate Products & Third-Party Links

MoldRiskIQ reports may include product recommendations through affiliate partnerships. These recommendations are based on the risk factors identified in your assessment. If you purchase a product through an affiliate link, the Company may receive a commission at no additional cost to you.

The Company does not guarantee the effectiveness, safety, or suitability of any third-party product or service. Product recommendations are informational only and do not constitute endorsements. You assume all risk associated with any third-party purchases.

15. Data Usage

By using the Service, you consent to MoldRiskIQ collecting, processing, and storing the data you provide (including property addresses, user contact information, and assessment results) in accordance with our Privacy Policy.

16. Prohibited Uses

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law
Attempt to reverse-engineer, decompile, or extract the scoring algorithms
Scrape, crawl, or use automated tools to access the Service
Submit false, misleading, or fraudulent information
Share account credentials with third parties
Use the Service to harass, defame, or harm any individual or entity
Resell or commercially redistribute reports without written authorization

17. Account Termination

The Company reserves the right to suspend or terminate your account at its sole discretion, without notice, for conduct that violates these Terms or is otherwise harmful to the Company, other users, or third parties. Upon termination, your right to use the Service ceases immediately. Previously purchased reports remain accessible for a reasonable wind-down period. No refunds will be issued upon termination.

18. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the Commonwealth of Pennsylvania. You waive any right to participate in a class action lawsuit or class-wide arbitration.

19. Explicit Acknowledgment

By using the Services and/or purchasing a report, you acknowledge that you have:

Read and understood these Terms
Voluntarily agreed to all provisions
Specifically agreed to the no-refund policy set forth in Section 6
Specifically agreed to the indemnification and limitation of liability provisions
Understood that all outputs are for informational and educational purposes only and are not a substitute for professional inspection
If uploading documents: confirmed that you have the lawful right to share them

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

22. Modifications

MoldRiskIQ reserves the right to modify these Terms of Service at any time. Changes will be posted to this page with an updated revision date and version number. Material changes will require re-consent before new purchases can be made. Continued use of the Service after non-material changes constitutes acceptance of the modified terms.
